TUPE Transfers

TUPE Transfers are something that Crystal Clean Service Ltd is familiar and experienced with dealing with. TUPE stands for Transfer of Undertaking of Protection of Employment.

This comes into force when you change cleaning companies and means that the employees (cleaners) employed by your previous cleaning company automatically then become employees of your new cleaning company when they take over the new cleaning contract, on exactly the same terms and conditions that they were on with your previous cleaning company.

 In this way, the employees get to keep their jobs and their employment is protected in this way.

 It sounds very complicated but there is no need to worry as it is a matter for your previous and new cleaning company to sort out between themselves and the employees and to overcome any issues that may arise.

 You as the customer are not affected in this case.

 If, however, the cleaning employees were employed directly by you, i.e. ‘on the books’ and you wanted to begin to outsource your cleaning to another party only then would you need to become involved.

 There are a few things to keep in mind when dealing with TUPE as an employer, and they are:

•  Don’t worry or panic
• Don’t let your current cleaning provider scare you into sticking with them by using TUPE as an excuse – it’s not your concern
• If you’re still worried, get some legal advice, if only to set your mind at ease.
